Two males — a 24-year-old and a 17-year-old — are accused of shooting in the direction of three St. Paul police squad cars and a crowd of people gathered outside Sam’s Dairy on Maryland Avenue East earlier this week.
While a bullet hit the bumper of one of the vehicles and another went through the wall of nearby Coin Laundry, nobody was injured. The fully marked SUV squads parked outside the store around 7:30 p.m. Wednesday after a store employee called to ask for assistance with a crowd of people that had gathered in the parking lot, court documents say.
The squads were parked on the south side of the parking lot facing north when someone in a 2008 Chevy Impala with no license plate heading west on Maryland fired three rounds toward the store and the vehicles, according to charges filed in Ramsey County District Court Friday.
The squads pursued the vehicle and a high-speed chase ensued, ending when the Chevy swerved into traffic and crashed at Maryland Avenue East and Duluth Street.
The driver, Marcus Maurice Holmes, 24, fled and was arrested about a block away. Raheim S. Clerk, 17, sustained a broken hip in the crash and was taken to Regions Hospital.
Officers found a .38 gray revolver between the Chevy’s driver’s seat and center console.
In an interview with officers, Holmes said he and Clerk saw the crowd of people outside Sam’s Dairy when they left the house to get some food that night, explaining that they didn’t see any police at the retailer when they drove by, according to the criminal charges.
When he turned around to drive by a second time, he said Clerk fired a couple shots toward the store and then yelled “Police” prompting Holmes to speed away.
He said Clerk is “associated with Selby 1200 gang members,” and that the members of rival gang “H Block” gang are known to hang out at the market, according to the criminal complaint.
Clerk told police that Holmes was his brother and that Holmes “was trying to convince him” to shoot at the crowd because it’s a known “East Side” hang out when they saw the group gathered outside the market that night, according to the charges.
He reportedly said Holmes took off their vehicle’s license plate so nobody could identity their vehicle and instructed Clerk to put on a mask before he fired into the crowd.
Clerk said he did not see the police SUV’s at the scene when he shot.
Holmes’ criminal history includes a conviction for terrorist threats and first-degree burglary. He is charged with being involved in a drive-by shooting, fleeing an officer and unlawful possession of a firearm.
